The law to increase enforcement of labor laws imposes personal, civil, and criminal responsibility on clients of manpower companies in the fields of guarding, security, cleaning, and catering. This responsibility is for upholding the rights of contracted employees employed by them and for fulfilling all obligations stipulated in various labor laws towards these contracted employees.
According to the law, the service procurer bears civil and criminal liability: a financial penalty can be imposed on the service procurer and the CEO of the corporation personally for violation of the law's provisions by the contractor, if the service procurer does not act to rectify the violation or cancel the signed service agreement and for forfeiture of the contractor's guarantees.
The service recipient shall bear criminal responsibility if they do not supervise and do not take all possible measures to prevent offenses against the contractor's employees employed by them. The law imposes criminal liability on the service recipient and the CEO at its head for entering into an agreement for the provision of services that does not comply with the law's conditions.
The law applies to corporations that order services from manpower companies in the fields of guarding, security, cleaning, and catering when:
– The service is provided by at least four contractor employees, whether the employees are employed by the same contractor or by different contractors.
The service is provided for a period of at least six months, on a regular or continuous basis.
The inviting corporation was notified of the contractor's breach of obligation towards its employees.
Under the law, the service procurer must take reasonable measures to prevent harm to the rights of subcontracted employees employed by them, including relying on periodic checks conducted by a certified wage auditor.
